What Is An Analog Drug?

Analog drugs (spelled analogue in England) are also referred to as “designer” drugs. This is because they were created to replace similar compounds that had been banned by federal or state governments. The chemicals are substantially similar to illegal Schedule I or II drugs, such as cocaine or heroin, and can produce the same effects. Creators aimed to give the same high sensation without the threat of a drug crime charge with things like bath salts.   

Today, the government treats analog drugs intended for human consumption the same as the Schedule I or II drug they are replacing. The Drug Enforcement Agency is given emergency scheduling power, which means they can determine that a certain designer drug becomes an illegal controlled substance. When this is done, Michigan will often follow suit and make that analog drug illegal here in our state.

Are Analog Drugs Legal?drugs

No. Designer drugs have gained popularity as people try to escape criminal drug charges, and the government has noticed. In Michigan and federally, analog drugs are now heavily regulated. Being charged with a crime in Michigan involving an analog drug can result in penalties as severe as charges for common street drugs.

These drugs are meant to mimic the chemical makeup of a specific illegal drug. One example is alpha-Methylfentanyl, called China White, which is intended to mimic the effects of heroin. It is considered 200 to 6,000 times more potent than morphine. Drugs such as China White are of increasing concern because they have a high potential of overdose and can result in death. There is an additional concern because often analog drugs can go undetected in a drug screening. This can cause problems for probation officers, parole workers, employers and drug treatment centers. The manufacturers are working diligently to create tests that will identify these drugs.

Michigan Analog Drug Laws

  • Use of Analog Drugs in Michigan:
    Analog Drug use is a misdemeanor offense in Michigan. If guilty of this crime, penalties include up to one year in jail, a fine of up to $1,000, or both.
  • Possession of Analog Drugs in Michigan:
    Analog Drug possession is a felony in Michigan. If guilty of this crime, you could be sentenced to up to two years in prison, and/or a fine of up to $2,000.
  • Delivery or Manufacturing of Analog Drugs in Michigan:
    The most severe crimes involving analog drugs in Michigan are the manufacturing, delivering, or intent to deliver the drugs. All of these offenses are felony drug crimes. Any of these crimes can result in up to 15 years in prison and/or a fine of up to $250,000.The consequences of a conviction for a designer drug crime can be devastating. It can result in incarceration, suspension of a driver’s license, and payment of fines. The state of Michigan takes analog drug crimes very seriously, and it will not overlook the analog drug because it is not a crime involving common drugs.

As with other drug crimes, sentencing could be more severe if analog drugs were delivered to a minor or close to a school, park, house, business, or church. If it is not the first drug conviction, sentencing will also likely be more severe. This is known as enhanced sentencing or habitual offender sentencing here in Michigan.
